Mediation Opening Statement

Thanks for coming to our mediation, my name is Alexander George. Mediation plays a pivotal role in reaching amicable solutions to problems that people encounter. The mediator is a neutral party who oversees the mediation process. There should not be a personal relationship between the mediator and any of the party, and if such relationships exist they should be along professional lines. Although phones are an essential gadget, they are not allowed during mediation and as such parties are normally encouraged to keep them on silent mode. Whatever is shared is confidential, and as a way to enhance this, all the notes are required to be destroyed five days after the mediation session. The only information shared, will be the one agreed upon by the parties. As a means of enhancing a firewall between mediation and other divisions mediations laws are not to be used as evidence or neither will the mediator be a witness.

The mediation agreement contains terms of service that stipulate how the mediation sessions will be conducted. By signing the papers, all parties will have agreed to abide by the terms of the mediation. Opening statement by the mediator communicates the rights entitled to all the parties during the sessions. It further makes the parties aware of what is to happen, so that they can be fully prepared for the entire sessions. Apart from the opening statement from the mediator, each party will be required to give out their opening statements

Each member is required to acquaint themselves with information based on the parties opening statement so that they can adequately address issues that might come up during the sessions. All information concerning the mediation will be conducted in a joint meeting. In case the parties agree that there should be a caucus, after the private meetings, each party should be made aware of what was discussed during the private meetings. The time spent with one party might differ, but that does not indicate any favoritism. Commonly what is shared in the caucus between the mediator and the one of the party might not be the same, and these are the reason for the differences in time. Once an agreement is reached agreement papers should be signed, and in case there is no agreement other alternatives methods can be adopted. As part of creating conducive mediation environment, there should be housekeeping to create a clean environment. Lunch will also be provided, and the parties can go for lunch during the mediation breaks.
